At Raine & Horne Peninsula Properties, we respect the privacy of your personal information in our care and are bound by the thirteen Australian Privacy Principles contained in the Privacy Amendment (Enhancing Privacy Protection) Act 2012, which amends the Privacy Act 1988.

Our commitment to your privacy is set out here in our Privacy Policy which describes how we deal with personal information. This Privacy Policy relates to personal information we collect and handle directly through our Peninsula offices. The overriding principle upon which our policy is based is that we will never disclose your personal information to any third party without your specific authority, unless required to do so by law.

It is important to us that you know how your personal information is stored and used by Raine & Horne Peninsula Properties.

What is personal information

When used in this policy, the term “personal information” has the meaning given to it in the Act. In general terms, it is any information that can be used to personally identify you. This may include (but is not limited to) your name, contact details (including phone numbers and email addresses) and possibly financial information. If the information we collect personally identifies you, or you are reasonably identifiable from it, the information will be considered personal information.

How we collect personal information

We collect your personal information directly from you. We do this in ways including:

  • Through your access and use of our website (or our affiliates) or social media;
  • During conversations between you and our representatives, such as (but not limited to) at property open for inspections:
  • When you complete an application to lease of a residential or commercial/retail property;
  • When you sign a selling or managing agency agreement with one of our representatives;
  • or when you purchase a property through one of our representatives;

How do we disclose your personal information

We may disclose your personal information to:

  • Our employees, related bodies corporate, contractors or external service providers for the operation of our business, fulfilling requests by you, and otherwise provide services to you, including without limitation, IT systems administrators, debt collectors, and professional advisers such as accountants or solicitors;
  • Specific third parties authorised by you to receive information held by us;
  • As required or permitted by any law (including the privacy act).

Purposes for collection, hold, use and disclosing of personal information

Our primary purpose is to enable us to perform our business activities (i.e. real estate services) and to provide best possible quality of service. We collect, hold, use and disclose your personal information for the following purposes:

  • To manage or sell your property;
  • To lease or sell you a property;
  • To provide you with local or industry news, information or advice;
  • To communicate with you including by email, mail or telephone;
  • For our administrative, marketing (including direct marketing) or promotional offers;
  • To provide your updated personal information to us or our contractors/trades;
  • As required or permitted by any law (including the privacy act).

Please note that all personal information is password protected by our staff and held electronically with our software service providers, Sherlock Software and rhCompass. If you are an existing client of Raine & Horne Peninsula Properties such as a current landlord, tenant, vendor or buyer your personal information is also stored in a hard copy format at our premises.

We implement a range of measures to protect the security of your personal information as well as measures in respect of destroying personal information that is no longer needed for any lawful purpose.

We can assure you that your personal information will not be shared, sold, rented or disclosed other than as described in this Privacy Policy.

Promotional activities and Marketing

We may provide you with marketing communications and information on an ongoing basis about new properties to the sale or rental market, monthly newsletters, local or industry news or updates, or anything else which we feel may be of interest to you which relates to the services our business provides. These communications may be sent in various forms, including mail, telephone, SMS or email. If you indicate a preference for a method of communication, we will endeavour to use that method whenever practical to do so.

In addition, at any time, you may opt-out of receiving marketing communications from us by contacting us (details below) or by using the opt-out facilities provided on our electronic marketing.

How you can complain about a breach of privacy

If you believe your privacy has been breached by us, have any questions or concerns about our Privacy Policy please, contact us using the contact information below and provide details of the incident so that we can investigate it.  We will treat your requests or complaints confidentially. Our representative will contact you within a reasonable time after receipt of your complaint to discuss your concerns and outline options regarding how they may be resolved. We will aim to ensure that your complaint is resolved in a timely and appropriate manner.
